777 Carioca drops action against Vasco and asks TJRJ to pull appeal | OneFootball

777 Carioca has dropped its interim measure against Vasco and, with the club and Vasco SAF, asked the Rio de Janeiro Court of Justice to take a connected appeal off the 24 September hearing list.

According to Globo.com, the case had been listed in the TJRJ’s 20th Private Law Chamber. The parties are seeking to close the first instance proceedings and dispense with the appeal.

A joint filing was submitted on Monday and notified to Judge César Felipe Cury, recording an agreement over the issue that prompted the appeal. 777 opened the interim measure in the Capital’s fourth Business Court, then withdrew it on 3 September with Vasco and the SAF consenting.

Following that withdrawal, the parties asked for the underlying case to be dismissed. The request has not yet been approved by the court. The file has been awaiting a decision since 24 August.

Vasco, Vasco SAF, 777 and the councillors involved have therefore sought to pull that hearing and for the TJRJ to await the first instance ruling. If the withdrawal is approved and the interim measure is extinguished, they want the court to recognise the appeal has lost its object.

The agreement also sets out that 777 will pay any costs and expenses tied to the interim measure, while each party will cover its own lawyers’ fees.
