A São Paulo court has found Palmeiras liable and ordered the club to pay R$ 20,000 to a Flamengo supporter identified as Thiago after incidents at Allianz Parque during last year’s Paulistão final against Corinthians. According to ESPN, the case centred on the club’s duty of care.

Thiago attended the match with his wife, Soraya, a Palmeiras fan. The couple live in Rondonópolis, Mato Grosso, and were on holiday in São Paulo.

Wearing a black shirt, a colour Palmeiras fans associate with Corinthians, Thiago was subjected to verbal and physical abuse and had a cap stolen. He was told to either buy a green shirt or leave the stadium, and left out of fear.

The couple said they even received death threats inside Allianz Parque. Palmeiras argued they had not proved moral damages and suggested the choice of black clothing contributed to the situation.

The R$ 20,000 award is below the R$ 100,000 the couple sought. The report added that attempts were made to contact Palmeiras, and Flamengo’s vice-president declined to comment.

The court held the club responsible for ensuring safety in the stadium, citing the Statute of the Fan, which states the competition organiser and the holder of home advantage share responsibility for safety, and that granting rights to third parties does not remove liability.
