São Paulo state and federal prosecutors have asked the Superior Court of Justice to reopen the case against Fábio Marcondes, vice mayor of São José do Rio Preto, accused of calling a Palmeiras security guard a monkey.

According to Globo.com, the incident happened in February 2025 after Palmeiras beat Mirassol in the Campeonato Paulista. Marcondes was charged with injúria racial, then obtained a court order that suspended the proceedings.

Prosecutors have submitted videos and argue the words "macaco velho" can be heard. A document signed by state prosecutor general Paulo Sérgio de Oliveira e Costa disputes claims of illicit evidence, stating AI tools were used only to complement human analysis.

The row began after a request that Marcondes' son leave the corridor between the dressing rooms and the team bus inside Mirassol's stadium. During the exchange, a Palmeiras guard protested against racism. Pushing followed and Military Police intervened.

Palmeiras filed a police report and the Civil Police opened an inquiry. During the probe, Marcondes took leave from the vice mayor’s office on three occasions and resigned as works secretary, later returning to his duties about 20 days later. Prosecutors have also asked that he lose the vice mayor post.

The complaint was admitted by judge Patrícia da Conceição Santos in Mirassol. Marcondes had at least one habeas corpus request rejected before securing an injunction that halted the case, which prosecutors now want reversed.
