RAÚL ASENCIO will avoid prison and criminal liability over a sexual video filmed in south Gran Canaria without consent, one a minor, if he apologises in court. Prosecutors set that condition after he wrote to the judge and paid compensation, with a hearing due on Thursday.
According to El Periódico Mediterráneo, the defence sought dismissal after both complainants withdrew their filings, after initially seeking four-year terms. The prosecution alone proceeded, alleging two offences against privacy and seeking two years six months.
The adult accepted his explanation, saw his role as secondary and asked that he not be punished. The 16-year-old also accepted, saying his conduct differed and that he admitted an indiscretion and aimed to repair the harm. Private claims of €58,000 were settled confidentially.
The trial will continue against Ferrán Ruiz, Juan Rodríguez and Andrés García. Prosecutors accuse them of filming without consent and distributing child pornography, and seek four years seven months, a six-year restraining order and €25,000 per victim.
On 15 June 2023 at Beach Club Amadores in Mogán, Asencio stayed by the pool with the adult, while his three team-mates went with the two complainants to a private cabin. Prosecutors say they knew one girl was 16 and that Ruiz and Rodríguez filmed without consent, before the trio shared the material. On 21 June, Asencio asked Rodríguez for the clip, received a single-view version and showed it to a third party.
