Brazil's prosecutor general Paulo Gonet has sent a favourable opinion to the Supreme Federal Court backing Flamengo's attempt to be recognised as 1987 champions alongside Sport, according to Coluna Do Fla.
The submission argues that Flamengo's 2017 rescissory action is well founded, seeking to overturn the court's First Panel ruling that had nullified a 2011 decision recognising both clubs.
It calls for the rescission of the impugned decision and for the finding that RDP/CBF 02/2011 was void to be set aside. The opinion says Sport's recognition must be preserved within the strict limits of the final judgment, so shared titling would not be barred and the Recife club would not lose the championship.
In 1987, with no funds to run the league, the CBF said it would not stage the Brasileirão. The Clube dos 13 then created the 16-team Copa União, drawing major sponsors, strong crowds and television audiences.
CBF later staged its own competition without those 16 teams, named the Yellow Module, and labelled the Copa União the Green Module. It ordered a four-team play-off between the top two from each, a directive the leading clubs rejected.
Flamengo and Internacional refused to face Sport and Guarani, who were awarded walkover wins, then contested the final won by Sport. Flamengo had earlier won the top-tier competition 1-0 with a Bebeto goal.
