Fernando Diniz has been cleared by the STJD after a flashpoint in Corinthians’ 0-0 draw with Athletico-PR at Neo Química Arena last Thursday, in the 21st round of the Campeonato Brasileiro.
According to Meu Timao, the coach had been charged under article 250 of the CBJD for an unsporting or hostile act, carrying a possible suspension of one to three matches.
The case arose after he slapped the hand of Athletico-PR midfielder Jadson during a first-half melee. Prosecutor Marília Fontenelle kept the complaint, saying a coach should quell, not escalate, disorder.
Auditor Dra. Ana Luiza Oliveira Ralil voted to acquit in a session lasting under five minutes, a view unanimously adopted by the STJD Pleno. She noted Diniz had already been shown a yellow card by referee Paulo Cesar Zanovelli da Silva for the same incident.
She cautioned against a second disciplinary sanction for the same act and found no evidence of unfairness, hostility or risk to the opponent’s physical integrity. Her vote said Diniz only sought to move the Athletico-PR player away, so the complaint was unfounded.
Corinthians’ lawyer Dr. Sérgio Engelberg did not deliver an oral argument, instead aligning with the auditor’s reasoning.
The acquittal means Diniz can lead Corinthians on Thursday at 20:00, when they host Internacional in the Copa do Brasil last-16 second leg at Neo Química Arena. After a 2-0 first-leg defeat at Beira Rio, they must win by two to force penalties or by three to progress outright.
