“The trial had two phases, first the preliminary issue, which was the prescription that the defense believes is irremediable. This process should not even have been judged, this will be faced on appeal. And also in relation to the merits, Flamengo obviously respects the decision of the sports justice and will appeal it. I think the same argument that was used to understand the removal of article 243, that this was a tactical orientation, that is, it was expected of Bruno Henrique to take a third yellow card, is the same argument that had to be used to understand that this is not an unsporting, unethical attitude, because if it is part of the rule of the game, you can use it to your advantage. How can you say that it is an illegal attitude from the point of view of convicting an athlete because of it? So, what would remain is only, at most, a supposed privileged information that Flamengo understands did not occur, since any average football and betting connoisseur would understand that Bruno Henrique would force this third card. Flamengo understands that he should be acquitted, the process should not have existed due to the prescription. And, at most, an application of the penalty, as was the dissenting vote, in article 191, third paragraph, for a possible privileged information, which Flamengo also disagrees, but would at least bow to this understanding.”
