Supreme Court rejects Sandro Rosell appeal to raise compensation for pre-trial detention

The Supreme Court has refused to admit Sandro Rosell’s cassation appeal to increase his compensation for time spent in pre-trial detention, keeping the 232,500 euros awarded by the Audiencia Nacional. The former Barcelona president had sought 29.7 million euros.
According to El Periódico Mediterráneo, judges cited a lack of objective cassational interest to form jurisprudence. Rosell was held for 645 days, from May 2017 to February 2019.
The Contentious-Administrative Chamber said his challenge attacked the lower court’s assessment of evidence and sought a case-specific ruling, which it deemed incompatible with a cassation model focused on protecting the norm and ensuring uniform case law.
The four-page order also notes that the Audiencia Nacional’s ruling did not deliberately depart from existing jurisprudence, as claimed. Although he disputed its approach, the Audiencia recognised his right to State liability compensation for judicial error, contrary to the Justice Ministry’s earlier refusal.
Rosell was released as his trial began after almost two years on remand, having faced an initial 11-year prosecution request. He was accused of laundering commissions allegedly received from former CBF president Ricardo Teixeira through his sports marketing company, BSM, to secure, in 2006, the TV rights to 24 Brazil friendlies for 27 million euros for a Saudi audiovisual group.
Judges acquitted him applying the in dubio pro reo principle, noting the payments could be legitimate business remuneration and the companies acted as intermediaries. After the court moved to release him, the prosecutor cut the request from 11 to 6 years.
