Gerson accuses Flamengo of bad faith and vendetta in legal case

Gerson and FGM Sports have filed their defence in Flamengo’s R$ 42.7 million claim against them, alleging the club acted in bad faith, pursued revenge and breached labour rights, and asking the case be thrown out. According to Globo.com, the submission was made by the Cruzeiro midfielder and the company run by his father, Marcão.
The document, lodged at 22:48 on Wednesday in the 25th Civil Court of Rio de Janeiro, argues clause 6.2 was fulfilled when Zenit paid the indemnity, so no penalty applies. The lawyers contend payment means contractual compliance, not default.
They add he renewed without noticing a drastic cut to the indemnity clause. A handwritten resignation dated 03/07/2025 was, they say, produced on club HR advice and described as routine that would not affect an amicable termination with Flamengo and Zenit.
The defence cites six irregularities, including non-use of his image to suggest the image deal dodged labour charges, late delivery of the TRCT on 12/08/2025 after queries went unanswered, and an undated FIFA Club World Cup 2025 prize receipt that was never paid. It also alleges non-payment of R$ 6,304,999.92 in signing-on bonus.
His lawyers say he has stayed publicly silent but believes he is the target of a vendetta by Flamengo’s current president after he joined Cruzeiro, also referencing the dismissal of Bruno Spindel from Flamengo. They question why the action was only filed after his return from Russia.
Flamengo has been contacted for comment and has not yet responded.
