Real Madrid have had both of their appeals try to postpone their La Liga opening match against Osasuna, scheduled for August 19, rejected by the Competitions Committee Sole Judge and the Second Instance Committee.

This has left Real Madrid with only one option to explore in their bid to reschedule the opening game of the season, reports Mundo Deportivo.

The last resort

As per the Spanish outlet, Real Madrid must now turn to civil jurisdiction and request interim relief through ordinary legal channels, as they can no longer appeal to either the Administrative Sports Tribunal (TAD) or the Higher Sports Council (CSD).

The first rejection came on 31 July from Jose Alberto Pelaez, the Sole Judge. The second denial followed yesterday from the Second Instance Committee of the Spanish Football Federation.

Real Madrid have now exhausted all possible avenues within the Spanish sports justice system. Since the matter is now considered private under the law, the only legal recourse left is civil jurisdiction. The TAD and the CSD no longer have authority to hear this type of appeal.

Real Madrid now have twelve days to file a case in the civil courts. This is the only legal channel through which the club can request interim measures to suspend and postpone its first league fixture.

However, this process falls outside the scope of sports justice and depends heavily on the judge assigned to the case. Given the short time frame, the most viable and immediate option is to seek interim relief to freeze the federation’s decisions while the court examines the case.

Why can Real Madrid no longer appeal to the TAD or CSD?

The answer lies in the new Sports Law, in effect since December 2022. Article 117 stipulates that disputes concerning competition matters must be resolved in civil courts, a provision that did not exist in the previous legislation.

In fact, the same will apply to disciplinary matters once the law is fully implemented. In the future, any disciplinary issue, after passing through the Competition and Appeals Committees of the Spanish Football Federation, will also have to proceed via civil jurisdiction.

What remains to be seen is how the civil courts will rule in this case.
