A new trial over Maradona’s death, targeting seven healthcare workers, begins Tuesday in Buenos Aires after the first was annulled in May 2025 over a magistrate’s role in clandestine courtroom filming.

The original case opened on 11 March 2025 and was voided on 29 May when judge Julieta Makintach’s participation in a planned documentary came to light.

"It was as if my dad had died again," said Jana Maradona. "I want the trial to be completed and the truth to be known." She told EFE in December the failed process helped her put everyone in their place.

Maradona died on 25 November 2020, aged 60, from cardiorespiratory arrest while receiving home care in Buenos Aires province. The choice and quality of domiciliary care were central and are expected to be revisited to assess avoidability and liability.

Back in the dock are neurosurgeon and personal doctor Lepolodo Luque, psychiatrist Agustina Cosachov, psychologist Carlos Díaz, Swiss Medical coordinator Nancy Forlini, doctor Pedro Di Spagna, nurse coordinator Mariano Perroni and nurse Ricardo Almirón.

Luque is now represented by Francisco Oneto, who also defends president Javier Milei in libel and slander cases and was not involved in the first trial.

Maradona’s daughters said Luque favoured home care. Prosecutors argue he was not properly attended to and signs of heart failure were ignored. They also accuse Cosachov of mismanaging medication and not leading resuscitation, though the halted trial heard no significant evidence on that, while Díaz’s defence cites clean toxicology.

Further allegations include inadequate monitoring by Di Spagna, poor home provision by Forlini, and inconsistencies between nursing care and records. Hearings will be held on Tuesdays and Thursdays at TOC No 7 in San Isidro.
