A serious legal case is now unfolding following racist abuse directed at Marcus Rashford during a match against Real Oviedo on September 25.

According to information published by AS, the Public Prosecutor’s Office of the Principality of Asturias has formally requested a prison sentence of one year and three months for a young supporter accused of shouting a racist insult at the Barcelona forward.

The incident took placewhen Rashford was preparing to take a corner. Prosecutors state that the accused shouted a racial slur loudly enough to be heard by nearby spectators. 

The act has been described as a direct attack on the player’s dignity, allegedly motivated by contempt based on skin colour.

What are the consequences?

What makes the case even more significant is how quickly the moment spread online. A stadium assistant captured the incident on video, and the clip was later uploaded to social media platforms.

From a legal standpoint, prosecutors are treating the case as a crime against dignity on racist grounds under Articles 510.2.a and 510.5 of the Spanish Criminal Code, combined with an offence against moral integrity under Article 173.1. 

In addition to the requested prison term, they are seeking a fine of €2,880, a four-year ban from working in teaching, sports or leisure environments, disqualification from passive suffrage, and a €2,000 compensation for moral damages.

If the court were to convict only on the offence against moral integrity, prosecutors are still pushing for the same prison term, alongside a stadium ban of more than five years covering competitions organised by La Liga, the RFEF, UEFA and FIFA.

With authorities now pushing for custodial punishment, the message is clear: abuse inside stadiums can carry consequences far beyond the pitch.
