Rui Costa’s financial default, recorded on the Bank of Portugal’s blacklist over debts linked to 10 Invest where he is a shareholder and guarantor, is fuelling debate over possible implications for his leadership of Benfica’s SAD.
According to Observador, the CMVM was asked about the case and said it does not have the competence to assess the president’s suitability. Penal lawyer Paulo Saragoça da Matta argues that such scrutiny should exist at the regulator, warning that its absence could leave a legislative gap in the governance of sports companies.
10 Invest has past-due charges exceeding 660,000 euros, including default interest and other costs, arising from the purchase of five land plots in the Serra de Carnaxide. The company’s total debt to Montepio Geral is about 15 million euros.
This default could make it harder for Rui Costa to secure bank financing, and it also raises questions about his fitness to serve as president of Benfica’s SAD.
Lawyer Miguel Pereira Coutinho contends that even if the CMVM lacks powers to judge such cases, Benfica’s SAD should still carry out an internal assessment of the governance impact.
