São Paulo court rejects MP-SP appeal against Duilio in Corinthians corporate card case

A São Paulo court has rejected an appeal by the state prosecutor’s office against former Corinthians president Duilio Monteiro Alves in the club’s corporate card case. According to Meu Timao, he is accused of embezzlement for alleged personal use of the card during 2021-2023.
Judge Elaine Cristina Pulcineli Vieira Gonçalves, of the 15th Criminal Court of São Paulo, had accepted the complaint, allowing the case to proceed, but refused requests to freeze assets, to lift bank and tax secrecy and to impose other cautions. The MP-SP tried to reverse that via embargos de declaração, which were dismissed on Thursday.
She found the motion showed no obscurity, ambiguity, contradiction or omission, and merely sought to reopen the merits, which that remedy does not permit. Duilio remains a defendant and will face trial.
The judge also ordered the MP-SP to confirm which of two prosecutors is competent to continue, to pre-empt challenges over the natural prosecutor principle. Since 2025, Cássio Conserino has led filings against Duilio and Andrés Sanchez for the same alleged offence.
Duilio remains away from club duties, including the Conselho de Orientação. Prosecutors cite a loss of R$ 41,822.62 and seek R$ 31,366.96 in damages. The invoices reviewed span May 2021 to December 2023.
The wider probe began in August 2025 into spending by Andrés, 2018-2020, and Duilio, 2021-2023, after Andrés admitted personal expenses and a spreadsheet pointed to R$ 80,000 in 40 days. Investigators have heard key witnesses and requested documents from the club and its councils.
