Rafa Mir, on loan at Elche from Sevilla, faces a prosecution request for 10 years and 6 months in prison over the alleged rape of a 21-year-old at his home in Torre en Conill, Bétera. The incident is alleged to have occurred on 1 September 2024, shortly after he joined Valencia on loan.

The request comprises nine years for an alleged aggravated sexual assault with penetration and a further 18 months for injuries. Las Provincias reports that prosecutors are also seeking a 13-year ban on contact or approaching within 500 metres, seven years of post-release supervision, and an eight-year ban on any activity involving contact with minors.

In the same case, Mir’s friend Pablo Jara faces three years in prison for the alleged sexual assault of a second woman, after he is said to have touched her on three occasions while in a swimming pool despite her refusal. He could also face a €1,350 fine and €6,280 in compensation for an alleged blow to her face.

News of the prosecution’s request emerged a few days after a separate controversy during Elche’s LaLiga match against Espanyol at the Martínez Valero last Sunday. Espanyol’s Omar El Hilali alleged Mir made a racist comment.

The match report recorded that in the 78th minute El Hilali told the referee Mir had used the phrase ‘viniste en patera’. The anti-racism protocol was triggered and play was halted for three minutes. The report added that the officiating team did not hear the remark directly.
