São Paulo court rejects Duilio’s appeal, ex-Corinthians probe stays

The 1st Court of Tax Crimes, Criminal Organization, and Money Laundering of the Capital denied, in a decision published last Thursday (04), the request of former Corinthians president Duilio Monteiro Alves to suspend the police inquiry initiated in September 2023, which investigates possible irregularities committed by the club's directors.

Besides Duilio, the investigation also involves former president Andrés Sanchez, former administrative director André Luiz de Oliveira, councilor Manoel Ramos Evangelista, known as Mané da Carne, and businessman Fernando Garcia from Elenko Sports, all of whom have had their financial records breached. The information was released by Blog do Paulinho and confirmed by Central do Timão, which had access to the decision.

Defense claimed illegality in COAF reports

The defense of the former president contested the legality of the evidence attached to the inquiry, especially the sharing of intelligence reports from the Financial Activities Control Council (Coaf), a similar argument used by former president Augusto Melo, investigated in another case on charges of being part of a scheme to divert club resources.

The judge rejected the request, aligning with the understanding of the Supreme Federal Court (STF), reported by Minister Alexandre de Moraes, that it is legitimate to share financial reports with investigative authorities, provided the confidentiality of the records is preserved. The magistrate also cited a section of Moraes' decision, published on August 25, 2025, which clarifies the scope of the suspension of proceedings determined by the STF.

“I reiterate that the suspension of proceedings, nationwide, seeks to eliminate the risk of continuing decisions that compromise the effectiveness of the thesis of Theme 990 and legal certainty itself, so it does not imply the halting of criminal investigations, the revocation of precautionary measures, or the release of seized assets within pending criminal procedures or processes.”

In the decision, the Supreme Court dismisses the thesis that the continuation of investigations would depend on the prior validation of Coaf or Federal Revenue reports, an understanding that, according to the Court, could create obstacles to criminal prosecution. Based on this foundation, the judge of the 1st Court concluded:

“As can be seen, the suspension determination does not cover all cases that involve the sharing of intelligence reports, but only those that somehow disrespect the understanding established in Thesis 990, which is not the case with the present records. Thus, there is no reason to speak of suspending the police inquiry, which is why I deny the request.”

The decision keeps the investigations against the former president ongoing in the police inquiry initiated in 2023, which investigates anonymous complaints made at the time against directors and allies of the administrations. The accusations involve suspicions of money laundering, with diversions of club resources for personal purposes, allegedly carried out through fraud in transactions involving players and sponsors.

Update at 9:53 PM – After the publication of the article, the defense of the former presidents informed that they had filed the request in all the processes under their responsibility, due to the national suspension determined by Minister Alexandre de Moraes on the constitutionality of sharing intelligence reports, later clarified in a new decision by the minister himself. Lawyer Daniel Bialski added that the investigation is in its final phase and advocated for the closure of the inquiry, stating that “in light of the absence of any illegality, recognized by the police authority itself, the inquiry should be closed.”

Corinthians administrations under the MP's scrutiny

The last administrations of Corinthians are also under investigation by the São Paulo Public Prosecutor's Office, following reports of possible irregularities in the club's expenses during the terms of Andrés Sanchez, Duilio Monteiro Alves, and Augusto Melo.

The investigation is under the responsibility of prosecutor Cássio Conserino, who requested the removal of the former presidents from any position in the club's councils until the conclusion of the investigation and, last Thursday, set a 24-hour deadline for Corinthians to send the requested documents to the MP-SP within the scope of the Criminal Investigative Procedure (PIC). According to journalist Pedro Ramiro from Record, the club physically delivered the documents this Friday (05).
