Vasco defends legality of SAF sale in response to regulator

Vasco has defended the legality of its proposed SAF sale in a response to the National Agency for Football Regulation and Sustainability. The club argues the deal does not breach the Financial Sustainability System, the financial fair play introduced by the CBF this year.

According to Globo.com, the regulator requested information on the operation, and both president Pedrinho and investor Marcos Lamacchia have in interviews treated the agreement as signed. At this stage Vasco has only forwarded documents and maintains there is no impediment, with the transaction still not concluded.

ANRESF will now assess the case, a process that will not be quick. Steps include due diligence, analysis of the submissions, and a hearing with the parties, followed by a judgment on the merits. There are two instances, with two panels in the first instance and three judges, then a plenary can hear any appeal.

If the regulator finds a conflict of interests, the issue under discussion in this case, it may impose remedies as a condition for approval. For now there are no formal talks over alternatives between Vasco and Lamacchia. Marcos’s father, José Lamacchia, is the deal’s guarantor, founder of Crefisa and husband of Palmeiras president Leila Pereira.

In an earlier letter Flamengo argued the Financial Sustainability Regulation bars any person, natural or legal, from holding direct or indirect control or significant influence over more than one club. Marcos is José’s son and Leila’s stepson, and her Palmeiras mandate runs until December 2027.
