“The trial had two phases, first the preliminary issue, where the statute of limitations was raised, which in the defense's view is irremediable. This process should not even have been judged, and this will be addressed in the appeal. Also, regarding the merits, Flamengo obviously respects the decision of the sports court and will appeal it. I believe that the same argument used to dismiss article 243, that this was a tactical instruction—in other words, it was expected that Bruno Henrique would get a third yellow card—is the same argument that must be used to understand that this is not an unsportsmanlike or unethical act, because if it is part of the rules of the game, you can use it to your advantage. How can you say it is an illegal act to the point of condemning an athlete for it? So, what would remain, at most, is a supposed privileged information, which Flamengo believes did not occur, since any average football and betting fan would understand that Bruno Henrique would force that third yellow card. Flamengo believes he should be acquitted, the process should not have existed due to the statute of limitations. And, at most, the application of a penalty, as was the dissenting vote, under article 191, item three, for possible privileged information, which Flamengo also disagrees with, but would at least accept this understanding.”
