Sport have challenged an opinion sent to the Supreme Federal Court by Prosecutor General Paulo Gonet that backs Flamengo’s bid to be recognised as 1987 Brazilian champions, reiterating its claim to exclusive ownership of the title.
The club said in a statement that it is handling the matter with calm, but considers it odd to attempt to reopen in court a result set by the competition’s rules and already upheld by the judiciary.
Sport also argued that naming two winners of the same competition conflicts with sporting law and legal certainty.
In his submission, Gonet supports Flamengo’s argument that the Supreme Court’s First Panel erred when it held that the CBF could not, on sporting criteria, have declared another club the 1987 champion.
Flamengo is seeking to rescind the ruling that struck down a 2011 CBF resolution stating Flamengo and Sport were joint champions. Sport has been recognised as the sole 1987 champion by a final ruling since 1999. The case’s rapporteur, minister Edson Fachin, will now decide whether to accept the opinion.
