According to L'Équipe, at least one of the two civil parties in the Ben Yedder case has decided to challenge the ruling before the Court of Cassation, while the public prosecutor general will not pursue an appeal.
This follows the investigating chamber of the Aix-en-Provence Court of Appeal annulling the referral of Wissam Ben Yedder and his brother Sabri to the departmental criminal court on counts including rape.
The woman who filed a complaint against the player in summer 2023 is the party moving to contest the decision at the Court of Cassation.
The second complainant, who accused Sabri Ben Yedder, has not disclosed her intentions, with her lawyer declining to comment.
The prosecution has stepped back from a cassation challenge, arguing the appeal court’s ruling is a matter of factual assessment for the trial court and that cassation only examines points of law.
The proceedings will therefore continue, at least for the time being.
