Duilio accused of embezzlement, prosecutors seek safeguards

The former president of Corinthians, Duilio Monteiro Alves, has been charged by the São Paulo Public Prosecutor's Office for alleged embezzlement involving the use of the club's credit cards during his administration, from 2021 to 2023.

The prosecution argues that personal expenses were allegedly covered with Corinthians' funds, unrelated to institutional activities. The complaint is still awaiting judicial review for potential acceptance.

According to the document obtained by Central do Timão, the questioned expenses include payments made at duty-free shops, restaurants, hotels, hair salons, nautical stores, clothing sales websites, and other establishments that, according to the Public Prosecutor's Office, are not related to the club presidency's duties.

The prosecution claims that the expenses total R$ 41,822.62, already adjusted for inflation. Besides criminal accountability, the Public Prosecutor's Office demands full restitution of the amount and the payment of R$ 31,366.96 as compensation for material damages to Corinthians.

In the Public Prosecutor's view, Duilio is responsible for the facts due to the position he held. The complaint states that, as president, it was his duty to ensure the proper use of the club's resources, rendering irrelevant, for criminal purposes, any claim of ignorance of the expenses.

The Public Prosecutor's Office also charged the former financial manager of Corinthians, Roberto Gavioli, repeating the approach taken in a similar investigation involving Andrés Sanchéz, another former club president charged by the agency.

Precautionary Measures

In addition to the complaint, the Public Prosecutor's Office requested the court to apply some precautionary measures, including: prohibition of access to Corinthians' premises and contact with witnesses and officials; suspension from performing associative functions and any institutional representation of the club; prohibition from leaving the country without judicial authorization, restriction on travel within Brazil, and electronic monitoring. The decision on the application of these measures will be up to a criminal court judge responsible for the case.

What the Defense Says

In a statement, Duilio's defense claims that the expenses incurred during the mandate amount to about R$ 35,000, a value deemed compatible with the duties of the position. According to the lawyer, any expenses not directly related to the presidential function, amounting to less than R$ 1,300, were reimbursed immediately and voluntarily, before any investigation.

The defense also argues that the management's accounts were approved by the club's internal bodies and underwent an independent external audit. Finally, it emphasizes that the filing of the complaint does not equate to a conviction and that the former president trusts the regular progress of the process.

Next Steps

Now, it will be up to the court to decide whether or not to accept the complaint filed by the Public Prosecutor's Office. If accepted, Duilio will become a defendant and face criminal proceedings. In addition to Duilio and Andrés, the São Paulo Public Prosecutor's Office is also investigating the administration of Augusto Melo, who was removed from the presidency in August after a year and a half in office. So far, the former president is the only one not charged by the Public Prosecutor's Office.

Last Friday (12), the São Paulo court decided to suspend the process in which Andrés Sanchez is charged with embezzlement, due to the possible use of club resources for personal expenses, after the Public Prosecutor's Office requested the recusal of the judge responsible for the case.

Judge Marcia Mayumi Okoda Oshiro denies any impediment but chose to suspend the effects of the decision made last Thursday, in which she rejected the more serious accusations against Andrés, until the São Paulo Court of Justice rules on the Public Prosecutor's Office's request, while maintaining the precautionary measures in effect.
