Everton have been ordered to pay Burnley nearly £40m in compensation and interest after losing a legal dispute over breaches of the Premier League’s financial rules. The sum could influence their summer transfer planning.

Everton were punished for a 2021-22 PSR breach, docked 10 points in late 2023, a sanction reduced to six on appeal in early 2024.

Burnley, relegated in 2022, subsequently brought legal action. Their case argued that had a deduction been applied during 2021-22 they would have had a stronger chance to stay up, relying on the legal principle of loss of chance, where certainty is not required.

Relegation brings major revenue losses, while promotion back to the Premier League is often valued at around £200m, underlining the high stakes.

The club said in a statement that it is surprised and angered by the Premier League Independent Disciplinary Commission’s order, considers the ruling flawed in law and fact, rejects any finding that its PSR breach conferred a sporting advantage that caused Burnley’s relegation, views the decision as a dangerous and unworkable precedent, and has lodged an appeal it believes will succeed.

If the near-£40m bill stands after appeal, it would be an unwelcome development for Everton. Its precise effect on summer plans remains unclear, but any major hit could shape budgets, PSR and SCR calculations, and room for manoeuvre in the market.
