Everton have been ordered to pay Burnley compensation and interest of nearly £40m after losing a legal dispute linked to breaches of the Premier League’s financial rules. The figure could influence their financial planning and transfer business.

The case related to Profitability and Sustainability Rules and alleged financial loss. In a statement, the club said it has appealed and believes the ruling is flawed in law and fact, rejects any link to Burnley’s relegation and warns of a dangerous precedent, adding it remains confident of PSR compliance and that the Premier League has confirmed the decision should not trigger future PSR sanctions.

Everton were docked 10 points in late 2023 for a 2021-22 PSR breach, reduced to six on appeal in early 2024. Burnley were relegated in 2022 and later issued proceedings, focused on whether a 2021-22 deduction would have improved their chance of staying up.

The action rested on the legal concept of loss of chance, which does not require certainty but a credible missed opportunity. The cost of relegation is severe, and promotion is often valued at around £200m.

If the award stands after appeal, it would be an unwelcome development for Everton. The extent of any impact on summer plans remains unclear, but budgets, PSR and SCR calculations and room to manoeuvre could all be affected.
