Judge suspends four Corinthians electoral rules ahead of 28 November vote

A court has partly upheld a challenge filed three days earlier by João de Oliveira, a Corinthians member and lawyer for André Luiz de Oliveira, against parts of the club’s electoral code for the 28 November vote. André Negão, as he is known, is a pre-candidate for president.
According to Meu Timao, judge Renan Augusto Jacó Mota of the fifth civil court in Tatuapé issued an injunction on Friday, granting four of five requests and suspending those rules pending judgment.
He halted article five, which had imposed a compulsory fee for an emergency electoral fund, saying the Electoral Commission cannot add financial demands not set out in the statute.
The facial biometrics requirement to vote was also suspended, allowing members without recertification to vote with official photo ID.
Article 16 was put on hold and the club must give registered slates the full list of eligible voters. Data protection could not justify a ban, and only necessary registration data should be shared, with sensitive data protected.
Rules in article 18 and a July Joint Communiqué were also frozen, as they barred third-party payments and required in-person payment. The judge said any vote-buying suspicion must be examined case by case.
The only request rejected concerned article 15 on sanctions for electoral irregularities, citing the commission’s statutory powers and due process.
The case continues, and for now the four suspended items cannot apply in the 28 November election. Other pre-candidates are José Augusto Mendes, André Castro, Rozallah Santoro and Sérgio Janikian.
