Manchester City have confirmed they will appeal an independent commission’s finding that the club ran a £900million deception across nine seasons. The Premier League says possible penalties include fines, points deductions and other sporting sanctions, to be set at a private hearing.
According to The Athletic, City were found guilty of all but one charge as the league published the ruling on Tuesday.
City must first appeal to a new three-person panel from the league’s judicial pool. It reviews the decision rather than rehearing the case, so a different view of the facts is not enough. The Premier League says City have until Friday, October 2 to lodge.
Overturning factual findings is generally difficult unless there is a material error of law or procedural unfairness. Any hearing should be held within 12 weeks of lodging, with a decision within 30 days, though timings in such a vast case remain uncertain.
Beyond the appeal board, only tightly limited arbitration is available on grounds such as jurisdiction, bad faith, serious procedural error or irrationality. A failed arbitration could be tested in the High Court on similarly narrow bases, and CAS has no jurisdiction.
It is also unclear whether sanctions will be imposed before any appeal on liability is completed, or only afterwards. Either route would permit City to challenge any penalties.
