Prosecutor opens inquiry into possible court action at Corinthians

This Friday (5th), the Public and Social Heritage Prosecutor’s Office of the São Paulo Public Prosecutor’s Office opened an inquiry with the aim of evaluating a possible judicial intervention in Corinthians. The information was first published by the portal ge.globo.

On November 18, prosecutor Cássio Conserino, who is investigating the club’s card expenses over the last three administrations, had sent the representation to the Prosecutor’s Office for evaluation. The document prepared by Conserino is 50 pages long and lists 25 reasons for the inquiry to be opened by the competent bodies of the São Paulo Public Prosecutor’s Office.

The prosecutor, who works specifically in the criminal area, does not have the power to directly request a judicial intervention in Corinthians. Therefore, he forwarded the request to another prosecutor’s office within the São Paulo Public Prosecutor’s Office, which ended up accepting and requesting the opening of the inquiry.

The São Paulo Public Prosecutor’s Office can now order certain procedures such as the delivery of documents, hearings, and expert examinations, which could lead to the filing of a public civil action. Prosecutor Luiz Ambra Neto justified accepting Cássio Conserino’s request by stating that “the evidence of civil and criminal wrongdoing reinforces the need to investigate the facts, even with the examination of internal club matters, which possibly contribute to and reflect the chaotic scenario.”

He also points out that “the image of default that plagues and harms Sport Club Corinthians Paulista is the result of disastrous administrations, consolidating year after year.” In addition, Luiz Ambra Neto decreed total secrecy in the case records, since some documents are confidential and to prevent any possible leak of evidence from interfering with the investigation being conducted by the prosecutor’s office.

What is judicial intervention?

The concept of judicial intervention refers to a mechanism provided by law in which a foundation, company, or club shows signs of irregularities in its management, which may affect credibility, operation, and transparency. In such cases, the Public Prosecutor’s Office or the competent prosecutor may request that the courts temporarily assume control of the administration.

In football, the process occurs in the same way as with any private entity. If necessary, the judge may order the partial or total suspension of the actions of the current board. From there, a judicial administrator is appointed to take charge of the institution’s management. This person remains in the position until the courts determine that the entity has achieved more appropriate governance conditions.
