Rafa Mir sentenced to eight and a half years in prison for sexual assault

According to Superdeporte, the Fourth Section of the Valencia Provincial Court has sentenced Sevilla forward Rafa Mir to eight and a half years in prison for the sexual assault of a 21-year-old woman at his home in Bétera on 1 September 2024. The ruling is not final and can be appealed to the High Court of Justice of the Valencian Community. He spent this season on loan at Elche.
The court imposed seven years for sexual assault and 18 months for injuries. He must not approach the victim within 500 metres for 10 years and must pay 64,000 euros, including 50,000 for moral damages and 14,000 for injuries.
Judges found there was no consent in two episodes, first in the villa’s pool and later in a bathroom when the woman returned to collect her bag.
The panel considered the complainant’s account fully credible under three jurisprudential criteria and rejected Mir’s claim that all contact was consensual and arose from disputes between the two friends present.
The women met Mir and his companions in a Valencia nightclub before going to his Bétera home. Mir had consensual sex with one woman while the complainant stayed by the pool.
The court found that after leaving the bedroom he threw the complainant into the pool against her wishes, held and kissed her, touched her and inserted his fingers into her vagina without consent as she resisted and said no.
She left intending to go home and called her father, then returned for her bag. In the bathroom, Mir assaulted her again while she cried, struggled to breathe and asked him to stop. Prosecutors had sought 10 and a half years.
Co-accused footballer Pablo Jara was sentenced to two and a half years for sexually assaulting the second woman and for an offence against moral integrity, along with a restraining order and compensation.
