São Paulo court rejects Andres Rueda appeal to return to Santos membership

The Seventh Chamber of Private Law of the São Paulo Court of Justice has rejected the appeal by former Santos president Andres Rueda, leaving him expelled from the club's membership. The decision, published on Thursday, also keeps fellow Management Committee members José Carlos de Oliveira, Dagoberto Oliva and Renato Hagopoiam out.
According to Diario Do Peixe, Rueda's appeal alleged curtailment of his defence in administrative and judicial stages, breach of the isonomy principle, and scrutiny of the legality of acts of reckless management. The panel comprised Miguel Brandi, the president, José Rubens Queiroz Gomes, Ademir Modesto de Souza and Pastorelo Kfouri.
In a ruling signed by rapporteur Lia Porto, the court found the internal procedure had afforded adversarial proceedings and a full defence. It added that the refusal to admit evidence in the administrative sphere was reasoned and fell within the association's competence.
The judgment said the committee's decision drew on the fiscal council's opinion, which concluded there had been reckless management in several areas. These included the BRAX contract, sums involving KRASNODAR, bringing forward the 2024 Paulista championship, postponing benefits due to players until after the mandate ended, and advance receipt of Paulista championship sales.
The defence for Rueda and the other committee members can still appeal to the Superior Tribunal de Justiça or the Supremo Tribunal Federal.
