Council president expels members for abandoning posts

Ten Corinthians councilors officially lost their mandates this Friday (9). The decision was formalized through an order signed by the president of the Deliberative Council (CD), Romeu Tuma Júnior, who fully accepted an opinion from the vice-president of the CD and president of the Ethics and Discipline Committee (CED) Leonardo Pantaleão, recommending the measure.

The expulsion was declared by Tuma upon confirming the finding made by Pantaleão, in a disciplinary procedure that proceeded in the CED for almost two months, that these councilors violated article 77 of the alvinegro statute. This rule addresses the obligation of attendance at the body's meetings and sets limits on unexcused absences for councilors to maintain their mandates.

Of the ten councilors who lost their mandates, eight are lifetime members: Cláudio Marcon, Fernando Capez, Francisco Cuano Filho, Luiz Paulo Ferreira Teixeira, Marcelo Ackel Dualib, Marcos Surjan Trofo Filho, Nelson Real Dualib, and Rubens Tavares Aidar. The other two are triennial, both elected in 2023 by Chapa 82 (Movimento Corinthians Grande): Jair João de Lima and Paul Reiter.

What the order says

In the four-page document, to which Central do Timão had access, Tuma declared that the procedure in Ethics was conducted correctly, respecting the adversarial process, ample defense, and due administrative process. He also acknowledged that Pantaleão, who reported the case, considered the conduct of each of the ten implicated councilors individually.

The president of the CD further emphasized that, during his mandate at the head of the body, he included in all meeting calls that any absences of councilors should be justified at least one hour before the meeting times. Finally, based on the procedure's records, Tuma accepted Pantaleão's recommendation and determined the loss of the mandates of the ten councilors, for abandonment of their positions.

How does the CD stand?

With Tuma's decision, the Corinthians Deliberative Council now has, at the moment, 289 members, being 198 triennial and 91 lifetime. The scenario is not yet definitive, as all ten councilors removed from office this Friday have the right to appeal the decision. Those who wish to appeal will have their requests analyzed by their peers in a plenary meeting. However, since the next CD meeting is expected to occur only in February, until then, the expulsions remain in effect.

Central do Timão found that no replacement of lifetime members will be determined by the CD president. The decision would be motivated by the fact that the reform of the Corinthians statute, under debate at the club since last year, includes proposals not to appoint more lifetime members, or even to abolish the position, replacing it with a similar position but with honorary status, without voting rights.

The replacement of the two removed triennial members should occur with the appointment of two candidates from Chapa 21 (Liberdade Corinthiana), the first alternate slate elected in 2023. As a group, this slate no longer exists, but its 25 elected members acquired the right to alternation to the CD during the election, and this right remains even with the end of the slate itself. The appointed alternates should be the two individuals with the longest association time at Parque São Jorge among the eligible members.
