Everton face near-£40m order to pay Burnley after PSR dispute

Everton have been ordered to pay Burnley compensation and interest of nearly £40m after losing a legal dispute over breaches of the Premier League’s financial rules. The sum could affect their financial planning and transfer business.
The club said in a statement that it has appealed the Premier League Independent Disciplinary Commission’s decision and believes the ruling is fundamentally flawed in law and fact. It rejected any link between Burnley’s 2022 relegation and a sporting advantage and warned of a dangerous and unworkable precedent, adding it is confident of a successful appeal and of ongoing PSR compliance. It also said the Premier League has confirmed this ruling should not trigger any future PSR sanction and that no further comment will be made until the appeal concludes.
Burnley pursued legal action after Everton were found to have breached Profitability and Sustainability Rules, arguing they suffered financial loss. Their claim relied on the legal principle of loss of chance, which does not require certainty that they would have stayed up.
The Clarets argued a deduction applied in 2021-22 would have improved their survival prospects. Everton were docked 10 points in late 2023 for a 2021-22 breach, a sanction reduced to six on appeal in early 2024.
Relegation brings heavy financial damage, with promotion often valued at around £200m. If the near-£40m award stands after appeal, it would be unwelcome and may shape Everton’s summer budget, PSR and SCR calculations and room to manoeuvre in the market.
