Sunderland’s Premier League rivals Everton have been ordered to pay Burnley compensation and interest approaching £40m after losing a legal dispute over breaches of the competition’s financial rules. The matter is not yet concluded.
The club said in a statement that it was surprised and angered by the ruling, has appealed, and believes the decision is flawed in law and fact. It rejected any finding that a sporting advantage from its breach caused Burnley’s relegation, warned of a dangerous and unworkable precedent, and said it believes the appeal will succeed. Everton added it remains confident on PSR compliance, with Premier League confirmation this should not trigger any future sanction, and that it will make no further comment until the appeal concludes.
Burnley sued over infringements of the Profitability and Sustainability Rules, arguing they suffered financial loss. Relegated in 2022, they contended that a deduction applied in the 2021-22 campaign would have improved their chance of staying up, relying on the legal principle known as loss of chance.
Everton were docked 10 points in late 2023 for a PSR breach in 2021-22, a punishment later reduced to six on appeal in early 2024.
If upheld, the bill would be unwelcome at Goodison Park and could shape budgets and room for manoeuvre in the transfer market. The sums at stake reflect the scale of Premier League relegation and promotion, with promotion often cited as being worth about £200m.
