Former Corinthians president suffers fresh court defeat in impeachment case

Augusto Melo, former president of Corinthians, suffered another defeat in court this past Saturday, the 25th. The São Paulo Court of Justice unanimously decided to reject the appeal filed by the former alvinegro leader, which requested the annulment of the extraordinary meeting of the Deliberative Council (CD) on May 26, which resulted in his definitive removal from office.

Augusto Melo's request was reported by Judge Clara Maria Araújo Xavier, in the 8th Chamber of Private Law. In her vote, she concluded that the club's internal process showed no irregularities and followed both the Social Statute and the right to a full defense, thus there were no grounds for its annulment.

Augusto Melo had alleged partiality on the part of Romeu Tuma Júnior, president of the CD, in addition to questioning the restriction of defense and lack of judicial justifications for his removal. However, the TJ-SP rejected these points, maintaining that the Judiciary cannot decide on the merits of decisions made by private associations, highlighting that the assemblies and calls were conducted according to the club's rules, and that the former president had the opportunity to express himself in writing.

Thus, the previously issued sentence remains valid, and Augusto Melo's impeachment remains in effect. In addition to rejecting the defense's arguments, the TJ-SP ordered the former president to pay R$ 8,000 in attorney fees. This amount was increased, as it was initially set at R$ 5,000.

It is worth remembering that the removal and subsequent impeachment of the former leader occurred due to the developments of the scandal involving the betting house VaideBet, former main sponsor of Corinthians. Along with allies, Augusto Melo was indicted by the Civil Police for money laundering, qualified theft, and criminal association and has been a defendant in court since July 22, after the acceptance of the complaint by the São Paulo Public Prosecutor's Office.
