Prosecutors ‘seek’ 10 years and six months in prison for Elche forward Rafa Mir over an alleged aggravated sexual assault on a 21-year-old woman in September 2024, according to Las Provincias.

The request comprises nine years for aggravated sexual assault involving penetration, plus one and a half years for an injury offence.

It also asks for a 13-year ban on contacting or approaching within 500 metres of the woman, eight years of disqualification from roles involving contact with minors, seven years of supervised release, and €64,000 in compensation. The woman has an adjustment disorder with mixed anxiety and depressed mood and a bruise on her right arm.

The alleged assault took place on 1 September 2024, when Mir was a Valencia player, at his home in the Torre urbanisation in Conill de Bétera, Valencia. The case has overshadowed his time at Elche and will continue at least until June, when his loan ends.

Mir was detained, then gave remote testimony in October from Palma de Mallorca to the judge in Llíria, Valencia. He was charged with sexual assault involving penetration and violence and was ordered to post €12,500 bail.

His lawyers anticipate a trial, date pending, and continue to deny all allegations and contest the indictment. Mir has avoided public comment and does not plan to discuss the case in depth until a final ruling. Elche have upheld his presumption of innocence and declined to comment on the latest development.
