Supreme Court justice Luiz Fux has admitted Flamengo as amicus curiae in the challenge to Provisional Measure 1.394/2026, which bans online betting offers and advertising.

Signed by President Lula on Friday 25, the measure hits Flamengo hard because Betano is their main shirt sponsor.

As amicus curiae, the club may submit data and arguments but is not a party. The case was filed by ANJL and IBJR, who warn of irreversible effects before Congress reviews it and seek urgent scrutiny.

Flamengo said it aims to provide technical input from a directly affected club and help the court weigh wider sporting impacts. Its petition projects up to R$ 430 million in losses in 2027 and says any later rejection would not revive ended contracts.

Betano pays R$ 268.5 million per season under a deal running to 2028, which the company has informally warned could be at risk. “We will stop signing players and start hiring lawyers,” president Luiz Eduardo Baptista said, forecasting a R$ 400 million hit next year and citing the Lucas Paquetá deal with West Ham as at risk, in comments to FlamengoTV.

Flamengo’s admission does not decide on suspending the measure. The Attorney General’s Office has 72 hours from Monday 28 to respond, after which Fux may rule alone or take the case to the full court. Until then, withdrawals are allowed until 23:59 on 05 October, and platforms are barred from the next day. In Congress, the MP lasts 60 days, extendable by another 60, and expires if not voted. Lula has argued that football’s best eras did not rely on betting.
