According to Globo.com, his lawyer João Henrique Chiminazzo confirmed the move in an official note.
The representative says the club owes two months of salaries, three of FGTS, five of image rights and seven of signing-on fees.
He added that Mayke made significant concessions to avoid a court dispute. After days of talks there was consensus on figures, but when formalising the deal Santos tabled an offer about 25% lower and changed key terms, called it final, and the breakdown in trust led to the legal filing.
Santos were contacted but had not commented at the time of publication. There was also no agreement on legal fees and commission, as the club did not intend to extend any settlement to the end of the contract.
Mayke had been training separately while negotiating an exit. Out of the plans of Cuca and his staff, he remains under contract until 31 December 2027.
The 33-year-old is the second player to seek termination in court, after Tiquinho Soares was recently released by Santos over late image rights and salary payments.
Signed last year after leaving Palmeiras, Mayke has made only 20 appearances for the club.
