According to Meu Timao, the STJD on Thursday morning dismissed Corinthians midfielder André Luiz’s appeal, ruling him out of the Majestoso against São Paulo.

The Tribunal Pleno unanimously followed rapporteur Luiz Felipe Bulus in upholding a two-match suspension imposed last Thursday. The ban was under Article 254 of the CBJD for violent play after his challenge on Thiago Mendes, which brought a first-half dismissal.

Corinthians’ defence accepted the intensity of the tackle but argued there was no violent conduct to fit Article 254 or Article 250, which covers an unfair or hostile act during a match.

The panel also cited the case of Carrascal of Flamengo, who was sent off for a similar incident and also saw his appeal rejected. With this ruling, André will miss one more Campeonato Brasileiro fixture, having already served the first game against Mirassol last Sunday.

A separate item concerned a bid to overturn the Third Disciplinary Commission’s acquittal of Vasco midfielder Thiago Mendes after he criticised the refereeing at full time. He had been charged under Article 258 of the CBJD, which covers conduct contrary to discipline or sporting ethics and carries a possible ban of up to six matches.

Thursday’s session kept the acquittal in place after video was shown, concluding he did not breach the rule and that punishing him would conflict with democratic values of freedom of expression.

Corinthians host São Paulo at Neo Química Arena on Sunday 10 at 18:30 in the 15th round of the Campeonato Brasileiro.
