Vasco have gone to court to stage the Copa do Brasil quarter-final first leg against Vitória at the Maracanã. According to Globo.com, the club wants to enforce last year's memorandum with Flamengo and Fluminense, who run the stadium, arguing the veto lacked justification.

The club nominated the Maracanã to the CBF on 19 August, then received a refusal the next day citing pitch preservation and maintenance windows. It is seeking urgent relief to secure the venue.

Vasco say the stadium has handled a heavy 2026 load, including eight matches in 15 days in May. They add further games are due before an NFL event on 27 September, so pitch protection should not block the 26 August tie.

Capacity is central. The filing cites about 78,800 at the Maracanã versus roughly 21,900 at São Januário, arguing a larger venue would boost access and revenue.

The club points to a Memorandum of Understanding with Flamengo and Fluminense granting eight dates, four in 2025 and four in 2026, covering Copa do Brasil ties and requiring objective technical and operational grounds for any refusal.

Vasco say they have 2026 dates available and that the denial lacked an objective technical report showing the pitch could not be used on 26 August. With six days to go, delays could disrupt ticketing, security and logistics.

They ask the court to order the Maracanã’s availability on terms applied to other clubs or under the MoU, plus a R$ 20,000 per hour penalty for non-compliance.
