Diniz has been charged by the STJD for his post-match comments after Corinthians' 2-1 defeat to Mirassol on Sunday, under article 258 of the CBJD, and could receive a ban of up to six matches.
According to Globo.com, the complaint stems from his news conference at José Maria de Campos Maia, where he sharply criticised referee Matheus Candançan and said the VAR, led by Marcio Henrique de Gois, was absurd.
He argued the officiating was very poor, that cards were not shown and time-wasting was not addressed. He considered the penalty against Matheus Bidu debatable and insisted there was a clear foul on Rodrigo Garro before Mirassol's second goal, asking why VAR did not intervene. He also noted VAR was used to overturn a dismissal but not to cancel Mirassol's goal.
The STJD prosecutor's office cited item two of the second paragraph of article 258, which covers conduct contrary to sporting discipline or ethics, including disrespecting members of the refereeing team or complaining disrespectfully about their decisions.
His hearing is set for Friday at 10:00 at the STJD headquarters in Rio de Janeiro.
