Andrés Sanchez fights MP-SP charges over improper Corinthians card

The former president of Corinthians, Andrés Sanchez, who has been charged by the São Paulo Public Prosecutor's Office for embezzlement, money laundering, and falsification of tax documents in the case of the improper use of the club's corporate card, is now trying to block the progress of the case.

This Friday (17), his defense filed a request with the 2nd Court for Tax Crimes, Criminal Organization, and Asset Laundering, asking the court not to accept the charges brought by prosecutor Cássio Conserino, who also requested a search and seizure warrant at the former executive's residence. The prosecutor justified the request by stating that the measure seeks to seize objects obtained through illicit means, instruments used or intended for the commission of crimes, and materials that may serve as evidence of the investigated offenses.

In the motion, Andrés Sanchez's lawyer, Fernando José da Costa, questions the handling of the case by the Public Prosecutor's Office, alleging there is an “intense media spectacle, turning each step into a public episode.”

Andrés's defense also alleges bias on the part of the prosecutor, as he is a declared Corinthians fan, citing as an example the expression “party with the members' money,” used by Conserino at a press conference last Wednesday (15).

“This is not just about an emotional identification with the club, but a potential condition of being a co-interested party/victim in the case itself, which breaks the impartiality required of the prosecuting body and raises suspicion.”

Furthermore, the defense claims that the presence of Gaviões da Fiel at the press conference, combined with extensive media coverage, increased the case's impact and compromised the right to a full defense.

“The seriousness of the episode is heightened by the fact that, in addition to wide media coverage, the event also included the participation of members of organized fan groups — especially Gaviões da Fiel —, increasing the social impact and amplifying the risks of undue exposure and pre-judgment of the accused.”

Finally, Andrés's defense argues that part of the evidence supporting the charges was obtained illegally, through the leaking of documents on social media, and requests the annulment of the case.

After the charges from the São Paulo Public Prosecutor's Office, the former president, now a lifetime advisor of Corinthians, requested his removal from the Deliberative Council and the Advisory Council (Cori), of which he is an ex officio member.
