Corinthians members file legal protest against Andrés Sanchez

This Monday (24th), a group of Corinthians members filed a judicial protest against former president Andrés Sanchez, who led the club during two terms (2007-2011 and 2018-2020). The measure does not aim for immediate punishment that would result in asset blocking.

The intention is to communicate to the market and third parties the legal risks related to the former leader's assets: “The Applicants have no direct economic interest in the Respondent's assets, nor does this procedure result in any patrimonial gain for the Applicants to the detriment of the Respondent”, says a part of the document, which Central do Timão accessed.

“This voluntary jurisdiction procedure only results in notifying potential creditors about the circumstances that may affect the Respondent's assets“, is clarified in another part. The protest filed by the members is an alternative present in the Civil Procedure Code and serves to make a potential future dispute public.

In other words, the document does not establish any mechanism to prevent Andrés Sanchez from negotiating or selling his assets, nor does it present any accusation against the former president. The judicial protest only signals the possible risks related to the former leader's assets.

The members justify the measure based on investigations by the São Paulo Public Prosecutor's Office (MP-SP), which accused the former president of embezzlement, money laundering, and forgery of tax documents due to the irregular use of Corinthians' corporate card during his second term at the club (2018–2020).

Andrés Sanchez admitted part of the expenses when some of the invoices were leaked on social media. However, the Public Prosecutor's Office believes there were transactions exceeding those publicly acknowledged by the former president and, therefore, requested that he reimburse the club R$ 480,000, plus 75% of that amount as moral damages.

In the judicial protest, the members argue that using the club's resources for personal benefit constitutes “asset confusion,” something provided for in sports legislation and the Civil Code. They further argue that the members may be affected in the future, as Corinthians has not filed any action against the former president, and, in this scenario, the law provides for the possibility of subsidiary liability of the members of civil associations if there are not enough assets to fulfill the obligations.

In the coming days, the same group of members is expected to file a judicial protest against former presidents Duílio Monteiro Alves (2021–2023) and Augusto Melo (2024–2025), both investigated by the MP-SP for possible irregular expenses involving Corinthians' resources. The document should also mention former financial manager Roberto Gaviolli and counselors who, in some way, have a relationship with the club's assets.

The measure was filed because the members believe that Andrés Sanchez may dispose of or reduce his assets before any potential legal liability. Thus, the judicial protest serves as a warning to the market and third parties that there are risks associated with the former president's assets.

1) Registration of the protest in systems like RENAJUD, INFOJUD, and SISBAJUD, so that the existence of the notice is publicly recorded;

2) Publication of an edict to broadly inform the public;

3) Formal citation of Andrés Sanchez;

4) All notifications should be directed to the group's lawyers;

5) Setting a symbolic value for the case: R$ 100.
