Court upholds R$ 3.5m ruling against Corinthians over ex-full-back who retired at 23 | OneFootball

A court has upheld, on appeal, a ruling ordering Corinthians to pay about R$ 3.5 million over the knee injury that ended Daniel Marcos’s career at 23.

After a first-instance decision in May, the club appealed to the Regional Labour Court of the 2nd Region, which only overturned the part related to mandatory workplace accident insurance because the club showed it had a policy, according to Globo.com.

Removing that item reduces the award by R$ 204,000 from an initial estimate of R$ 3 million, but accrued interest lifts the overall sum back to roughly R$ 3.5 million.

The 14th Panel maintained the remaining orders, confirming the right-knee injury sustained by Daniel Marcos in December 2020, during an under-20 match against Grêmio, as a workplace accident. He suffered an anterior cruciate ligament tear and meniscus damage.

Material damages were set at R$ 2,286,764.4, payable in a single instalment, with a further R$ 200,000 for moral damages. The total is subject to monetary correction.

The reporting judge rejected the club’s claim that such a sprain could occur in everyday life, noting the injury happened during a match played for Corinthians. The club had not commented at the time of publication.
