Prosecutors have asked for 10 and a half years in prison for Elche striker Rafa Mir in his rape trial, with the alleged offences dating back to September 2024 when he was at Valencia.

Las Provincias reports that the incident is alleged to have taken place at the player’s home in the night of 31 August to 1 September 2024, after a Valencia match while he was on loan from Sevilla. It is alleged the 21-year-old woman suffered two non-consensual digital penetrations. Mir denies the allegations.

Mir was placed under formal investigation in September 2025. The prosecution is seeking nine years for aggravated sexual assault plus 18 months for assault and battery.

Prosecutors also want a 13-year restraining order preventing contact and requiring a 500-metre exclusion zone. They are seeking seven further years of supervised release and an eight-year ban on any paid or unpaid activity involving contact with minors.

The state is asking that he pay €64,000 in damages for physical and moral harm. The complaint noted a contusion on the woman’s right arm, and the indictment cites an adjustment disorder with anxiety and depressive symptoms.

Mir has scored seven goals in 21 league appearances for Elche this season. He is also accused by Espanyol defender Omar El Hilali of using racist language during Sunday’s meeting of the clubs, and the RFEF disciplinary committee has opened an investigation.
